Abstract: The Principle of Legality is the most basic principle of penal law in international community． The international criminal law， as one branch of the international law， is a kind of norms aiming to stipulate and punish the international crime for maintaining international social order． The Principle of Legality should be also a basic principle in international criminal law． This paper discusses the evolution， present situation and future of the principle of legality in international criminal law．

摘要： 罪刑法定原则是世界各国刑法普遍确立的一项最基本原则。国际刑法作为国际法的一个分支，是惩治规范国际犯罪和维护国际社会秩序的刑事规范。国际刑法遵循和适用罪刑法定原则是题中应有之意。但是，罪刑法定原则在国际刑法中的适用走过了一条坎坷之路。国际刑法中的罪刑法定原则路在何方？本文试对此问题作一探讨。
