Abstract: In some mountainous countryside of China where the rivulets wander though，the stones on the river—related：lands have been rapt without restraint．As to the stones，at least the right to environment and ownership could be feasible；however，it’s from the perspective 0f ownership that the villagers could be better remedied．：Following some historical clues deriving from the time of land—reform or even earlier．the collective ownership of these lands and mountalns，and meanwhile that of the stones thereon，could be confirmed．

摘要： 在一些水流流经的我国山区农村，河地上的石头被大肆盗取。这是否侵害了山民的合法权益？石头上可能成立环境权与所有权等权益类型，其中所有权的救济思路更具可行性。沿着土地改革乃至更早时期以下的历史线索，可以找到石头所从属的物，即河地与山岭为集体所有的依据，进而据以论定石头的权属。
