Abstract: This article is concentrated on the transition of approach of criminal law study in 19th century．In19th century，through scienctific methodology，criminology came into being．The article has thine parts：first，revolution of methodology：from ideal design to positive analysis；secondly，content revision：from c14me study to criminal study；thirdly，countermeasure transion：from punishment to social defence．

摘要： 本文论述西方19世纪刑事实证学派在方法论上的转型。18世纪，犯罪和刑罚的古典学派的理论占主导的地位。进入19世纪之后，将自然科学中的方法应用到法律科学领域，犯罪学得以产生，刑事法学开始了现代科学的时代。文章分为三个部分：第一，研究方法上的革命：从理想设计到实证分析；第二，研究内容上的变革：从研究犯罪到研究罪犯；第三，犯罪对策上的转向：从刑事惩罚到社会防卫。
