Abstract: In the legislation and implementation of laws，the conflict of interests is a decisive factor．Theanalysis on the interests groups of trade protectionism and free trade reveal the following trend：in the legislation of antidumping laws，the leading role is played by the interests of the trade protectionism；on the other hand，in the implementation of antidumping laws，the responsiLde utive officials also hold a stance of trade protectionism which tells usthe reason they advocate the trade protectionism  interests with the “zeroing”method．In a word，the trade protectionism interests determines the course of US antidumping laws’legislative and implementing activities．

摘要： 在法律制定和实施的过程中，利益冲突是一个决定性的因素。对美国贸易保护和自由贸易集团的分析揭示了这样一种趋势：在反倾销的立法过程中，起到主导作用的是贸易保住的利益诉求；而在反倾销法的执法过程中，具体负责反倾销法实施的行政官员也站在贸易保护主义的立场之上，这也揭示了为什么美国会采取“归零”这一方法来维护贸易保护主义的利益。总之，在利益冲突中处于优势地位的贸易保护主义利益决定了美国反倾销法立法和执法的价值取向。
