Abstract: he reform of interrogation system and standardizing public security organs’ law enforcement sites shapes monitoring interrogation mechanism.An empirical study in A city found that the frequency of illegal interrogation advocated by defendants has decreased since the implementation of new Criminal Procedure Law.However，torture is still the main form of illegal interrogation.Illegal interrogation mainly occurs during interrogation before criminal detention.The reason why illegal interrogation still exists is that monitoring interrogation mechanism has not been fully and effectively used.With development of standardizing law enforcement sites，investigators of A city’s public security organs have become accustomed to“interrogation under the lens”，which also results in spillover of confession under torture.And other forms of illegal interrogation are tolerated to some extent.In order to effectively suppress the illegal interrogation，we need to expand the case scope of interrogation recording，separate  interrogator from the interrogation place management，etc.

摘要： 侦讯制度改革和公安机关执法场所规范化建设初步形成了“监控式讯问机制”。以A市为例的研究发现：新《刑事诉讼法》实施以来，被告人主张非法讯问行为的频次有所减少，但涉及种类较多，刑讯逼供仍为主要形式；从时空形态看，非法讯问主要发生在刑事拘留之前在办案机关的讯问。非法讯问之所以还在一定范围内存在，一定程度上是由于“监控式讯问机制”尚未得到充分、有效的运用。随着执法场所规范化建设的全面展开，公安机关侦查人员已开始习惯“镜头下的讯问”，但也产生刑讯逼供的外溢现象，其他形式的非法讯问则得到一定程度的容忍。为了有效抑制非法讯问，需要从扩大讯问录音录像的案件适用范围，实现讯问主体与讯问场所管理主体的分离等几个方面完善监控式讯问机制。
