Abstract: ‘Civil Rights’(Chapter 5)of General Principles of Civil Code(Draft)basically follow the method of the the provisions of General Principles of Civil Law.Its provisions meet the requirements of ‘common factor’ and ‘normative feature’.Therefore, the chapter shall provide some more provisions, such as object of rights, civil interests.Some provisions should be reconsidered, such as whether‘right of honor’is regarded as one type of personality rights；whether it should replace ‘general principles of obligation’ with the simple provisions of obligation in this chapter.

摘要： 《民法总则草案》第五章规定了“民事权利”，基本上延续了《民法通则》的做法。从立法技术层面说，基本上符合“提取公因式”和“规范性”的要求，值得赞同。但这一章还有许多内容应当规定，如权利客体、民事利益等；有些内容应该仔细斟酌，如“荣誉权”是否属于人格权以及该章中的关于债的简单规定是否能够替代未来的债法总则等。
