Abstract: With the number of the short-term prisoners increasing, the issues for the short-term prisoners make prison management sluggish. The issues for the short-term prisoners not only aggravate the prison management efficiency, but also make recidivism ascending. It's successful exploration to  solve the problems for short-term prisoners through enacting the community penalties. Considering the functional deficiency of the penalties system that are short of capabilities to face challenges from the short-term prisoners, China should enact the community penalties to improve our punishment system. We could enact the community service, then make the semi-custodial penaty.

摘要： 随着短期监禁犯数量的上升，短期监禁犯症状在我国监狱管理工作中日益突显。短期监禁犯症状的蔓延，不仅加重国家管理监狱的负担，而且使得重新犯罪率上升。制定社区性刑罚是国际社会解决短期监禁犯症状成功的探索。鉴于我国刑罚体系存在的功能性不足，不能充分应对短期监禁犯症状所带来的问题，应当考虑制定社区性刑罚。我国可以从设立社区劳动刑入手，先规定社区性刑罚中的社区刑罚，然后规定半监禁刑。
