Abstract: The principle of actor sequitur forum rei is differentiated from the modern concept of litigation, and alsobreaches the impartiality and purposes of civil litigation. It has lost its value as a basic principle of territorial ju-risdiction ．We should rethink its reasonableness because of the wide influences of geo-factors to the judicature inour country. The author therefore presents corrective measures in order to treat the plaintiff and the defendant e-qually.

摘要： 原告就被告是地域管辖制度的传统原则，但该原则重被告轻原告，把被告住所地置于统辖地位，违反平等的基本要求，在地缘性因素对司法影响甚大的我国更应该反思其合理性。本文在反思的基础上提出了解决之策，以平衡保护原被告双方的利益。
