摘要： 行为加重犯是一个崭新的概念。文章通过对加重犯基本构成及加重因素的分析研究，提出所有的加重因素都可以被称为“情节”。情节加重犯的概念要分广义和狭义两种。在广义的情节加重犯中应当剥离出行为加重犯，成为独立的加重犯形式，并与结果加重犯、数额加重犯、狭义的情节加重犯一起行成加重犯完整的理论体系。

Abstract: The offense aggravated by behavior is a new concept．By analyzing and researching the basic structure of aggravate offense and its elements，the paper points out that all of the aggravate elements can be called circumstances ．Offenses aggravated by circumstances are devided into the general one and the concrete one．The offense aggravated by behavior should be separated from the general one，then becomes an independent aggravate form and shapes thecomplete theoretical system of aggravate offense with offenses aggravated by consequence，amount and others．
