摘要： 自由刑的运用政策是一国刑罚政策的重要组成部分，也是衡量一国刑罚政策轻重的重要标准。本文分析了自由刑在刑事政策上的合理性与局限性，并借鉴经济学上的边际效益法对自由刑进行分析，认为自由刑的合理适用应遵循“轻轻重重”两极化的刑罚政策。从这一结论出发，对我国目前的自由刑政策进行反思，并提出了我国自由刑政策合理化调整的若干建议。

Abstract: The policy of penalty of freedom-related is an important part of the penal policy of a state．It is alsoa significant criterion to evaluate the penal policy．Discussing rationality and localization of the penalty of freedom-relatedand analyzing it by means of marginal benefit in economics，the author holds that the penalty of freedom—related should beapplied rationally by following the polarization policy．Furthermore，the author puts forward some suggestion to rationalizethe policy of penalty of freedom—related in China．
