摘要: 《中华人民共和国行政强制法(草案)》已于2005年12月在十届全国人大常委会第十九次会议上经过第一次审议,常委会成员和社会各方面给予了积极肯定,同时存在不少争议,提出许多修改建议,其下一步走向引人注目。我国行政强制立法应坚持平衡理念、兼顾原则和最小侵害原则,在行政强制设定权分配机制、行政决定的强制执行体制、行政强制行为程序等方面,按照现代行政法治原则作出制度安排。这对于有效约束行政强制具有特殊价值,有助于建设法治政府,有利于实现维护公民权益与维护公共利益、尊重个人自由与维持公共秩序、保障公民权利与保障行政权力的辩证统一。几位长期参与行政强制法起草论证工作和行政强制理论研究的专家受邀撰写的本栏目文章,在上述方面提出诸多见解,可为立法机关和关注行政强制立法的读者提供参考。
Abstract: People’S Republic of China’S Administrative Coercion Law(Draft)has been confirmed at the first time on the 19th conference of the lOth NPC standing committee,and has been confirmed actively by the members and the whole society.At the same time,there remains many disputes and revised proposals.The next step will attract the public attention.Our legislation of administrative coercion should insist the equilibrium idea,the principle of giving attention to more sides and the least damage principle;the institutional arrangement should be done according to the doctrine of the nowadays rule of administrative law,on the aspects of distributive mechanism of administrative coercion’S establishing power,coercive ution system of administrative decision,administrative coercion procedure,and etc..It has special value on restricting administrative coercion effectively,is helpful to establish government by law.It Can also help realize dialectical unity of defending civil rights and public interests,of respecting individual freedom and public order,and of safeguarding civil right and administrative power.The articles of the column are written by several senior experts.It is those experts who have been participating in the drafting and demonstration of our administrative coercion legislation and have been doing research on administrative coercion theory for a long time.Thanks to those experts,many new opinions are put forward,which can provide reference and help for the legislative institution and readers who concern about administrative coercion legislation.
