摘要： 新兴的经济法部门以事实行为作为其基本特征，并形成了与民事行为相对应、相配合的态势。本文就经济法上事实行为进行了概念阐述和实证研究，并进一步在与民事行为比较的过程中，分析了经济法上事实行为的制度价值、技术功能、行为结构、法律评价。经济法上事实行为与民事行为的配合态势构成了“市场经济就是法治经济”的现代版本。

Abstract: Newly the economic law branch is as the fundamental characteristic with the factual behavior，and become the corresponding and cooperative situation with the civil legal act．This text proceeds to expound the conception about the factual behavior on the economic law branch and to research it in practice，on further in process that compared with the civil legal act，and analysis the system value，technique function，behavior construction，and behavior evaluation on law about the factual behavior on the economic law branch．The match situation about the factual behavior on the economic law branch and the civil legal act constitute the modern edition of“market economy is law—government economy”．
