摘要： 特别关系是一种典型的法条竞合现象；法条内容具有对立关系与中立关系时，并不存在法条竞合关系；补充关系只是特别关系的另一种表述；包容关系只是特殊关系的外表现象。对于特别关系，原则上采用特别法条优于普通法条的原则，但在一定条件下应当适用重法优于轻法的原则；某种行为没有达到司法解释确定的特别法条的定罪标准，但符合普通法条的定罪标准时，应当适用普通法条定罪量刑。

Abstract: Die Spezialitaet is a typical phenomenon of Gesetzeskonkurrenz. When the legal norms of the articles of criminal law are opposite or uncrossed, the phenomenon of Gesetzeskonkurrenz does not exist. Die Subsidiaritaet is another name of Die Spezialtaet. The inclusive relationship is just the extrinsic phenomenon. For the manage-ment of Die Spezialitaet, the principle of lex specialis derogat legi generali should be applied, and in some spe-cific circumstance, the serious article must be applied other than the lenient article ．If some harmful action is not suitable to the standard of conviction of the special article according to the criminal judicial interpretation, but it has statified the standard of conviction according to the general article, such a case should be dealt with the gen-eral article.
