摘要： 马锡五审判方式是陕甘宁边区司法的典范。边区特有的战时环境、乡土环境、边区社会转型和边区司法改革等因素共同作用促使了马锡五审判方式的产生。马锡五审判方式的精神实质是联系群众、为了群众，其普适的价值是司法为民与司法公正。马锡五审判方式为化解边区在战时的各种社会矛盾，稳定边区的社会秩序起到了重要的作用，从而产生了良好的社会效果。应该正确认识与评价马锡五审判方式。继承马锡五审判方式，是要继承其依靠群众、为了群众、实事求是的精神，而不是对其形式的简单继承。

Abstract: Ma Xiwu’s trial mode is a model of adjudication in the Shaanxi-Gansu-Ningxia Border Region, resulting from the joint forces of the border region’s specific wartime environment, local environment, the border region’s social transformation and judicial reform as well as many other factors. The spiritual essence of Ma’s trial mode is embodied by its close ties with the masses and its consideration for the masses ．Its universal value is justice for the people and justness of the justice ．Since its formation, Ma’s trail practice has played an important role in defusing various wartime social disputes and keeping social order and stability in the border region. It is necessary for us to reappraise it and carry it forward．We should inherit Ma’ s spirit, i. e, relying on the masses, suiting the people s convenience and seeking truth from facts, rather than its simple practices.
