摘要: 不动产登记法在性质上主要属于登记程序法,应对纳入不动产登记的权利类型、不动产登记的基本原则、登记管辖权、一般登记程序和特殊登记程序等问题作出规定。可以纳入不动产登记的权利不仅限于《物权法》和其他法律中规定的物权,还包括法律和行政法规规定的可以登记的债权。不动产登记的主要功用是公示不动产上的权利状态,但不动产登记对于不动产权利的变动所起的作用略有不同。不动产登记簿采取物的编成主义,只有权利人、利害关系人以及法律规定的国家机关才能查询不动产登记簿。

Abstract: Real estate registration law is registration process law in nature, dealing with the rights which may be registered in the real estate register, the basic principles of real estate registration, registration jurisdiction, general and special registration procedures, etc. The rights which can be incorporated into the real estate registration include not only the real rights stipulated in Property Law and other laws, but also the personal rights which be prescribed as registrable in the law and administrative regulations. The major function of the real estate registration is to make public the rights above the real estate, but the real estate registration plays a slightly different role in the change of real estate rights. Real estate register is asset-based registration. It can only be queried by the obligee, interested party, as well as the state organs stipulated by laws and regulations.
