摘要: 农民住房抵押的标的物为农民住房,住房所有权和宅基地使用权一并抵押。所有权人可以用自己的住房为本人或他人债务设定农民住房抵押,不受其他条件限制,但抵押权人应限于金融机构。农民住房抵押权的设立无须经本集体经济组织同意,抵押贷款用途亦不受其限制。农民住房抵押权的实现方式除折价、拍卖、变卖外,还可以是强制管理。农民住房抵押物处置时的受让人不限于本集体经济组织成员,但其在同等条件下享有优先购买权;非本集体经济组织成员在受让农民住房时,推定其对集体土地享有租赁权。

Abstract: The subject matter of the farmer’s house mortgage is the farmer’s house,and the land developing right is mortgaged together.House owner may set up the farmer’s house mortgage for his own debt or for other people’s debt not subject to any other conditions,but the mortgage holder should be limited to financial institution.The establishment of the house mortgage is not necessary to be approved by the collective economic organization,and the use of mortgage loans is not limited.The way of discount,auction,sale or compulsory management may be selected to realize the house mortgage.The assignee is not limited to the members of the collective economic organization,but the member is entitled to the priority of purchase under the same conditions.When the man who purchases the house is not the member of the collective economic organization,he is presumed to have the right to lease the collective land.
