摘要: “枫桥经验”已经成为中国特色法学知识体系、话语体系和法治体系的重要组成部分,也是相关知识、话语和实践得以融合的重要载体。有关“枫桥经验”的大量研究侧重于考察其内容,使用共同或相近的分析框架和政策话语,在某种程度上出现了研究的内卷化和泛化。若要推动“枫桥经验”研究的深入开展,需要转换研究视角,由侧重对其内容的研究,转向对其所蕴含的中国基层治理模式变迁路径的研究。“枫桥经验”蕴含的变迁路径,可被归纳为“顶层倡导—基层创新—中层承接—理论提炼—全国推广”。这一变迁路径使得“枫桥经验”由单一性经验转变为综合性经验,由局部性经验提升为全国性经验,由历史性经验演变为现实性经验。依循这种路径借鉴和推广基层治理典型模式,要处理好内生价值与外部推广、特殊性与普遍性、一统性与基层自主性之间的关系,防止可能出现的偏失。

Abstract: “Fengqiao Experience”has become an important part of legal knowledge system, discourse system and legal system with Chinese characteristics, and also an important carrier for the integration of relevant knowledge, discourse and practice.Much of the research on the“Fengqiao Experience”focuses on examining its content, using common or similar analytical frameworks and policy discourses.It presents the research status of involution and generalization.To promote further research, it is necessary to change the research perspective, from content research to the research on the transition path of China's grassroots governance model.The transition path contained in the“Fengqiao Experience”can be summarized into five steps:Top Level Advocacy, Grassroots Innovation, Middle Level Undertaking, Theoretical Refining, and National Promotion.This transition path transforms the“Fengqiao Experience”from a single experience to a comprehensive experience, from a local experience to a national experience, from a historical experience to a realistic experience.Following this path and promoting the typical model of grassroots governance, the relationship between endogenous value and external promotion, particularity and universality, unity and grassroots autonomy should be well handled to prevent possible deviations.
