摘要：

动态质押监管人的角色界定取决于对监管协议性质的认定。将监管协议界定为兼具委托合同与仓储合同的混合合同，监管人兼具“质权人的受托人与质物的仓储保管人”双重身份，并在其法律适用问题上采“结合说”的观点，对监管人应承担的法定义务分别准用委托合同与仓储合同之规定，有利于我国司法实务处理动态质押纠纷时，准确说明监管人法定义务的来源；有利于立法与学理区分动态质押监管人与浮动抵押代管人在功能价值等方面存在的差异。同时，我国未来立法在规定监管人资质条件时，应当区分立法规定的资质条件与质权人自由选择监管人的标准之间的差异，监管人资质在法律上只需具有商事主体资格和仓储经营资格即可。

Abstract:

What role does the supervisor play in the dynamic pledge depends on the identification of the supervision agreement.The supervision agreement should be defined as a mixed contract with both contents of contract for warehouse and contract for commission.Thus，the supervisor has the dual status of“trustee of pledgee”and“warehouse keeper of pledge depositor”.To adopt the view of“combination theory”which determines the statutory obligations of the supervisor will contribute to accurately explaining the source of legal obligations of the supervisor，and also distinguishing the differences between the supervisor of dynamic pledge and the receiver of floating charge in terms of functional value.At the same time，the future legislation of our country should distinguish the difference between the qualification of the supervisor stipulated in the legislation and the standard of the pledgee's free choice of the supervisor.The qualification of the supervisor only needs to be restricted to commercial subject and warehousing operation.
