摘要： 本文介绍了晚清名案杨乃武小白菜案，并指出了该案对清代法制史研究之重要价值。在对该案的具体分析的基础上，本文选取法官责任制度为核心问题，通过分析在清代严厉的官僚责任制度下，初审官余杭县令刘锡彤敷衍了事、匆忙结案的心理过程，探讨了晚清有关法官责任规定实现的可能性及其对司法官员行为的激励作用与负面导向。

Abstract: This article introduced the case of Yang naiwu and Xiao baicai，a famous case in late imperial China，and its important value for the study of legal history of Qing．Based on the analysis of this case，this article focusedon the issue of the responsibility of the magistrate Liu xitong，the judge of this case，and analyzed the mentation of hismiscarriage under the pressure of the roles about judges responsibilities in their judgement through which revealed thestimulation and passive infection of the judgement of the judges．
