摘要： 习惯在当代中国社会的纠纷解决中起着重要作用，在很多情况下，人们遵从习惯多于遵从法律。本文以个案为角度，探讨了在民间纠纷调解中民间习惯的作用以及这种作用的发生机制。从调查的案例得出结论，习惯的最大作用在于受到广泛的认同，通过习惯解决纠纷有利于执行。文章结论在我国法治建设中，应当注重发挥习惯的作用，应当承认习惯的效力。

Abstract: Custom has important function in solving the dissension in China society．In most conditions， custom has more function than law． The function of folk custom to intercede the folk dissension is discussed and the mechanism of this function is also discussed． The conclusion， that due to authorization of custom it is in fever of uting to intercede the dissension through custom， is drawn from the inquisitional case． In construction of rule of law in China，custom should be brought into play and its function should be accepted．
