摘要： 人类社会司法证明模式的历史沿革遵循了“否定之否定”的规律，即从自由证明到法定证明再到自由证明。自由证明模式和法定证明模式都是各有利弊的，而且当代世界各国的司法证明制度一般都属于两种模式的中和。当前，中国证据制度改革的方向应该是从自由证明走向法定证明。

Abstract: The historical developments of judicial proof in human societies followed the rule of negation of negation，from free proof to regulated proof and to free proof again……Both models of free proof and regulated proof have their merits and demerits．Now the judicial proof systems in most countries in the world are mixtures of two models．The direction of the．present reform of Chinese evidence system should be going from the free proof towards the regulatedproof．
