摘要： 父母对未成年子女的监护是我国监护制度中的核心内容，婚姻法中的相应条款较为单薄，尤其是对父母离婚后的监护问题更是缺乏系统规范。为此，我们需要对现行立法中监护制度的设置及其基本理念作重新的审视。

Abstract: Parents’right and obligation of custody of underage children is the core component in our custody system．The marriage law is rather weak in this territory，especially lack of custody guidelines for underage children after their biologic parents ale divorced．We need a better review of existing custody system，its essential elements and basic concept upon which whole system is constructed．
