摘要： 市场经济体制下交易是资源流转的主导方式，信用关系随着交易的空前频繁而逐渐成为资源配置的基础社会关系，从这个意义上说市场经济就是信用经济。当前我国社会诚信的普遍匮乏，日益成为阻碍市场经济体制完善的顽疾，而现代公证制度通过国家证明机构和公证人从事具有法律效力的证明活动，成为社会信用机制的保障。一方面，诚信是公证存在和发展的基础，也是公证在社会信用建设中发挥作用的基本前提；另一方面，完善的公证制度能对整个社会诚信机制的构建产生不可或缺的支撑作用。2005年8月28日第十届全国人民代表大会常务委员会第十七次会议通过、2006年3月1日起施行的《中华人民共和国公证法》，是我国构建社会诚信机制的重要法律。如何理解公证对社会诚信机制的作用？新《公证法》对我国公证制度有何发展？存在哪些不足？都是值得关注的问题。本刊特约请几位理论界和实务界的人士就这些问题进行讨论，以期对新公证法的实施有所裨益。

Abstract: Under the market economy system，transaction has been the primary model of resources circulation．Gradually，credit relationship has become basic social relationship which decided the distribution of resources in pace with unprecedented frequency of transaction．Market economy is credit economy in this sense．Nowadays，it’s the general credit deprivation that put sand in the wheels of improvement of market economy system．However，modem notarization becomes the safeguard of social credit system by means of valid notarial act made by notary organs and notary public．For one thing，good faith is the fundamental of existence and development of notarization；it is also the basic precondition that support notarization to play a role in the development of social credit．For another，sturdy notarization will help crucially to construct the system of good faith all through the society．The Notarization Law of the People’s Republic of China adopted at the seventeenth session of the tenth National People’s Congress Standing Committee on August 28，2005，and effective as of March 1，2006，is an important act to construct our social credit sysuem．How to realize the role of the new act？What kind of progress has been made to develop notarization？What’s the shortage of it？That’s what we concerned about
