摘要： 本文的主题限定在自然法思想及其在建构和谐社会背景下的中国自然法复兴这个老而又新的问题。主要观点是：中国古代没有形式自然法，但有实质自然法；当代中国自然法的复兴是自然法发展内在逻辑和我国法治进程的必然要求；在对中国当代形式自然法建构的问题上，我们只能采取“建构理性主义”的进路；当代中国自然法复兴，既有积极条件，也有消极条件。

Abstract: This article concentrates on the renaissance of the natural law under the background that an attempt is made to construct the harmonized society in China．Ancient China saw no natural law in form but did exist there a natural law in substance：the instinctive nature of the natural law and the evolution of rule of law in China will sure revive the natural law．With reference to the construction of contemporary：natural law．we’d better adopt construction rationalism．Both affirmative and negative conditions grow in China for the renaissance of natural law．
