摘要： 当今中国社会的精神信仰的危机带来了法律的精神危机，其源于一百年来中国社会精神转型的历史，对传统文化的否定带来了中国凝聚社会的精神力量的丧失。社会精神不仅决定法律的精神，也有助于法律的有效实施。当今中国的精神文明建设应是立足传统的开拓创新，在此基础上构筑法律的精神和内容。

Abstract: The crisis of belief in spirit in Chinese society has brought the crisis of law．In last hundred years，because the history of social spirit transformation negated traditional culture，the strength of spirit that agglomerates society has lost．Social spirit not only determines the spirit of law，but also helps to actualization of law．Today，we should build Chinese civilized spirit depends on traditional culture，and construct spirit and content of law by this．
