“罪”之渊源与哲学依据

摘要: 在世界各民族语言中,“罪”都是一个使用频率很高的用语。但“罪”的法律意义背后,有着很深的哲学意蕴。首先,“罪”与道德密切相关,在很多情况下,“罪”的判断实际上就是一个道德判断;其次,“罪”与宗教也有极深的渊源,在人类历史的一些重要进程中,宗教教义对于“罪”的内涵都发生了重要的影响。同时,“罪”也意味着社会责任的背叛,因为在大部分情况下,“罪”都是在与群体、与他人的联系中得以确定的。所以,从“罪”的渊源上进行探索,有助于我们对于法律、刑罚的深刻认识。

Abstract: Across all languages worldwide,“sin”is a frequently used word.Yet,behind its legal meaning,the word“sin”also possesses sociological,anthropological and philosophical meanings.First,“sin”is closely related with morality.In many cases,the judgment of“sin”is actually a moral judgment.Second,“sin”is originated from religion.During some important courses in human history,religious doctrines have greatly affected the connotation of“sin”.Meanwhile,“sin”means the betrayal of social responsibility.In most cases,“sin”is related with crowds of people and others.Exploring from the origin of“sin”will help us to build in-depth understanding of law and penalty.
