摘要： 文章首先分析了社区的定义、“域”定位以及相应的法律框架的法域定位问题；其次，简要评析了现行社区治理法律框架的法域归属，指出其公法主导的精神实质。在此基础上，结合对时下流行的几种社区治理法律框架构建思路及其法域定位的分析评价，提出了构建私法主导性的社区治理法律框架的新思路。

Abstract: The thesis first explores the different definitions of community，sphere location and the legal sphere location of the legal framework within which the community operates． It then briefly analyses the legal sphere location of the current legal framework highlighting its public law based characteristics． From this， the thesis proposes a new approach for establishing a private law based legal framework of the community governance．
