社会管理创新为何需要司法建议制度
——基于司法建议案例的实证研究

摘要: 中国法院基于自身的能力、经验等和社会责任,为了预防风险与未来可能产生的损害,在法律规定的解决纠纷的职责之外,还从事司法建议的活动,进而也使司法建议工作成为法院参与社会管理的重要形式。从《人民法院报》刊登的26份优秀司法建议书的内容与背景来看,法院的司法建议工作主要是基于案件当事人、行业协会、政府主管部门等主体缺乏对于裁判信息的获取能力和将上述信息转化为行为的能力,以及相关行为举措效果不佳的现实背景而开展的。在法治建设不断进步的背景下,司法建议应以提升社会主体对裁判信息的获取、转化、落实能力为出发点,其重点应从个体性案件转向类型化案件、整体性情势的梳理与研究,提出制度性的预防、规范、管理方案与对策,以成为推动社会管理创新的重要力量。

Abstract: Based on the contents and backgrounds of the twenty-six pieces of excellent judicial suggestion documents published in “People’s Court Daily”,the judicial suggestions of courts,mainly based on the fact that the social bodies such as parties of cases, guilds and government departments lack the capacity to obtain the information of decrees and further integrate these information into government decisions as well as the below-expected consequences of their measures. In order to prevent risks and future damages, courts, based on their advantages in capabilities, experience and social responsibilities, conduct judicial suggestions extensively that are out of their legal jurisdiction of adjudicating disputes, consequently making judicial suggestions become an important path for courts to participate in social management. Under the background of continual development of China’ s rule of law, the judicial suggestions of courts should focus on the improvement of social bodies’ capacities in obtaining and comprehending adjudication information, and put emphasis on the research transition from individual case to the classification and integration of cases, and further put forward institutional proposals and strategies in prevention, regulation and management, which will in turn make judicial suggestions become an important factor to propel the social management innovations.
