摘要： 上海道契在中国近代土地制度史、契约史上有着重要影响，为近代土地制度及契证制度的顺利建立做了铺垫，也使传统土地管理和契约运行方式和西方传入的土地和契约制度顺利衔接。上海道契在法律史上的影响不仅源于上海租界的独特地位，更是上海租界形成和发展过程中的各种因素以及独特的人文和地理环境共同作用的结果。这些因素共同塑造了上海道契的特殊法律地位。

Abstract: Shanghai Daoqi played an important role in the modern history of China and pave the way for the establishment.of Chinese modern land system and contract system. The particularity and influence of ShanghaiDaoqi not only originates from the special status of concession in Shanghai，it is also the results from the interaction of all kinds of systems and unique geographical environment. The ignorance of the central and localgovernment of Qing lay foundation for the expansion of Concession power. The abandonment of the policy andrestriction on ethnic Chinese into the Concession and the impact on land and housing demand is the economicmotivation. The different positions of Chinese government in Concession have different impact on the implementation of the system. Humanistic psychology and special social environment in south-east area of Chinainfluence the formation and change of the land system. These factors shape the legal status of the Shanghai title deed and then play a different role from other concession.
