摘要: 因为显著的功能性与型式化,行政行为成为传统行政法法教义学的核心。但伴随行政实践的变化与行政任务的更新,这一概念范畴却凸显诸多缺陷。行政法学者转而寻找行政法学体系新的“阿基米德支点”。在这些尝试中,法律关系学理在方法论上展现出了行政行为所不具备的优越性,且更符合复杂多样的行政实践。由于发展时间尚短,行政法律关系学理同样面临制度化和体系化程度不高、核心理论难以突破等困局。这些困局限制其成为行政法学新的支点,也制约了现代行政法学“轴心转移”的完成。尽管如此,行政法律关系学理作为一种全新的法解释和法评价工具的价值却不容忽视,法律关系和行政行为相互配合,更有助于提供“与时代相符的行政法教义学”。

Abstract: Because of the significant functionalization and formalization of administrative acts,they finally become the core of traditional administrative law doctrines. But changes of practices and updates of the tasks of theadministrative law highlight many flaws of the concept of administrative acts. The innovators tried to replacethe administrative act with the administrative legal relation in order to complete the shift of administrative lawdoctrine. This theory demonstrates many benefits in the theoretical methodology that the concept of administrative act does not enjoy, and is also more consistent with the increasingly complex and diverse administrative practices. However, the short development of the concept of legal relationship exposed many limitations. These difficulties not only confine it to be the new“Archimedean point” of the administrative law butalso hurdle the dogmatic shift of the modem administrative law. Nevertheless, its theoretical value as a newtool in the legal interpretation and evaluation should not be overlooked. Because of the respective irreplaceable superiority of the legal relations and the administrative act, the administrative law is more likely to enterthe“dual-cores era” in the future.
