摘要： 在我国有限破产主义立法模式下，为解决不具备破产能力的债务人向所有债权人公平有序地清偿，强制执行中的参与分配程序应运而生。受此目的牵制，我国的参与分配制度在适用要件上有其特殊构成。为了保护当事人的实体权益和程序权利，实行参与分配必须准确把握申请期日、清偿顺位以及分配程序，并在当事人权利受到侵害时，通过参与分配方案异议和异议之诉予以救济。

Abstract: In the mode of limited bankruptcy doctrine，participation in distribution system is mainly to make thedebtor without bankruptcy capacity to pay off all debts fairly and orderly. Under this objective，our participation in distribution system has its special composition. In order to protect the rights and interests of the parties，the application date，the Ranking of Claims and distribution program must be accurately grasped.When there has been a violation of the rights，parties may claim relief by distribution plan objection and objection lawsuit.
