摘要： 东京审判在表面形式上是战胜者对战败者的审判，然而，从程序和实际效果方面，它并不仅仅局限于“胜者”或“败者”。东京审判遵循“正当程序”原则，忠实记录了日本军国主义分子的战争暴行，以达到以史为鉴、面向未来、维护和平的目的，所以它不仅是战胜国、同时也是战败国的正义。东京审判通过将侵略及战争犯罪行为定罪，以达到禁止和预防国际罪行的目的，这是人类社会的理性、文明和进步。

Abstract: The Tokyo Trial may be viewed，by its appearance，as the one of Victorious countries over the Defeated Country.However，the significance of the trial，if being considered from the proceedings and actual impact，should not be limited within the so-called“victors”or“defeated”. The Tokyo Trial，by recording in detail and punishing the atrocities committed by the Japanese militarists，is to educate the younger generations and to prevent such crimes in the future.Therefore，it is not only the justice for the victors，but also the one for the defeated.As a matter of fact，the Tokyo Trial，by defining the aggressive acts as crimes under international law，aims at prohibiting and preventing such horrible crimes and is the reflection of rational and civilized development of our Human Beings.
