高校校规合法性审查的逻辑与路径
——以最高人民法院的两则指导案例为切入点

摘要: 虽然最高人民法院指导案例38号、39号都确认对高校校规的合法性审查,但未形成系统的逻辑与路径。合法性框架下的高校校规与国家立法的关系体现在两个方面,一是校规基于学术自治的法约束松绑,二是国家立法的框架保障功能。校规合法性审查的司法实践偏向于从国家立法层面上寻求高校校规合法性的依据,既扭曲了校规与国家立法之间法律关系上的定位,也忽视了校规合法性审查依据的效力差异与适用前提。对校规的合法性审查应当构建“目的-规范-原则”的三阶层审查结构。

Abstract: Both No.38 and No.39 guiding cases of The Supreme People’s Court admit the review of university regulations,but discussion on the review has not summarized systematic methods of it,which results in the lack of sufficient persuasiveness and acceptability of the guiding cases.The relationship between university regulations and national laws reflects in two aspects:one is the law deregulation of school regulations based on academic autonomy,the other is the protection framework of national laws.Currently the review of school regulations tends to seek the legitimacy foundation from the perspective of national legislation,which not only mistakes the legal relation between university regulations and national legislation,but also neglects the difference in the efficacy of the review basis of university regulations and the application precondition of the review basis.Consequently,a three-stage structure,namely“purpose-norm-principle”,should be built to develop the review of university regulations.
