论集体建设用地制度改革的法理基础

摘要: 摘要为实现农村土地制度改革的目标,集体经营性建设用地流转与土地利用管制之间关系的调整,应在保障农民地权的基础上,实现以市场为导向的地权交易与维护社会公共利益之间的适度平衡。为建立城乡统一的、开放的建设用地市场,克服建设用地制度的内在冲突,应完善土地征收制度,更新城乡建设用地增减挂钩机制,推进农村集体产权制度改革,重建土地利用管制的法律基础和土地收益分配体系。

Abstract: The rural collective construction land system provides a basic system support for industrialization and urbanization, but its negative practical effects become increasingly obvious.To achieve the goals of rural land system reform and adjust the relationship between collective business construction land rights transfer and land use control, China has to maintain a balance between the market-oriented land transaction and the protection of public interests while ensuring farmer's land use rights.Wee should improve the land expropriation system, renew the pothook mechanism of city construction land increase and rural residential land decrease, advance the collective property right system reform and the modernization of collective economic organizations, reconstruct the legal basis of land use control and the land profits distribution system.
