要：表达权是一个容纳了“表达自由”之内核且富有中国特色的政法表述。它既与“表达自由”具有学理上的关联，又在数字人权的时代背景下被嵌入了新的制度内涵。在理论上，表达权通过节制资本和立足于底线思维，扩展了“表达自由”的内涵，建构了数字人权时代的“新思想市场”。在功能上，表达权满足了新的时代需求，有助于通过制定良法表达人民意志和通过善治实现人民意志。表达权的实现，需要国家在消极层面不干涉公民的合法表达，也需要国家在积极层面为公民的合法表达提供必要的物质保障和制度安排。其中既包括经由基础设施建设来打破“数字鸿沟”，保障公民能够自由合法地“表”明自身观点，也包括通过制度安排尊重网络平台的自治并对其进行规制，使公民的观点“达”致受众。

Abstract:

The right of expression is a political and legal expression that incorporates the core of freedom of expression and also adopts Chinese characteristics.It is not only academically related to freedom of expression，but also embedded with new institutional connotations in the context of the era of digital human rights.Theoretically，the right of expression expands the freedom of expression.It constructs a“new marketplace of ideas”in the era of digital human rights by restraining capital and limiting the expressions in a proper boundary.Functionally，the right of expression meets the needs of the new era.It helps express the will of the people through the formulation of good laws and realize the will of the people through good governance.On one hand，the realization of the right of expression requires that the state does not interfere with citizens' expressions.On the other hand，it also requires the state to provide citizens with necessary material and institutional arrangements.These include breaking the“digital divide”through infrastructure construction to ensure that citizens can freely“express”their views，and also needs the state to make institutional arrangements that respect the autonomy of online platforms and at the same time regulate its business，so that the citizens' views could“reach”the audience.
