摘要： 何谓严格责任？我国刑法中有无严格责任？将来是否应当设置严格责任？对此，我国学者见仁见智、各执一词。历史地考察英美法系刑法中的严格责任和系统分析我国刑法的立法及司法现状之后，笔者认为，我国刑法中并无真正意义上的严格责任，将来也不应该在我国刑法中设置严格责任。
