摘要： 本文通过对近代法以自由权为重心和现代法以社会权为重心的深刻反思，提出当代中国法律体系应当奉行发展权为本位，并应以发展权精神重塑法的理念，将发展权提升为宪法人权，创制发展权基本法。

Abstract: Concerning the shift of liberty rights proposed by modem law to social fights emphasized by counterparty law， this article bring forwards Chinese legal system should be based on the right to development， by means of reconstructing the legal principal in the light of protecting the right to development， enacting Fundamental Act of Right to Development，and modifying the constitution to accommodate these rights．
