摘要: 旅游企业在与旅游消费者进行交易的过程中是具有交易优势地位的,但对这种交易优势地位如何调节、监督和规制则需要进行探讨。本文从限制旅游企业滥用交易优势地位行为入手,研究市场机制调节、协会组织监督和民事司法救济等对旅游企业滥用交易优势地位行为的制约,并在此基础上研究政府公权力是否规制和如何规制旅游企业滥用交易优势地位的行为。

Abstract: Tourism enterprises have dominant market position when their opposing party is consumer. Basing on research into limitation to abuse of dominant market position of tourism enterprises by adjustment of market mechanic, supervision of social organization and judicial redress, this essay makes attempt to probing the reasons and methods that government regulates abuse of dominant market position of tourism enterprises.
