摘要： 本文讨论围绕人权概念的主要争论，这些争论展示了对人权概念理解中的内在矛盾。这些争论表现在关于人权的自然性和社会性、人权的理念性和制度性、人权的基础性和理想性、人权的国家性和非国家性、人权的个人性和集体性等方面。人权概念中的内在矛盾问题是人权法律理论争论中的核心方面之一。

Abstract: This paper discusses the debates on the concept of human rights，which show the internal contradictions in the understandings of human fights．These debates include the topics of the natural nature and the social nature of human rights，the ideal nature and the institution nature of human rights，the base nature and the ideality nature of human rights，the state nature and the non—state nature of human rights，the individual nature and the c011ective nature of human rights，etc．The discussion of internal contradictions in the concept of human fights helps the understanding of the core of the human fights law．
