论非因自身过错未办理登记的不动产买受人之实体法地位

On the Substantive Law Status of the Buyer of Real Estate Who Fails to Register Without Their Own Fault

摘要:

后民法典时代尤应关注实体法与程序法的体系效应,执行程序中的实体法问题亟待民法理论与规范予以回应。已实际占有不动产且支付全部价款,但非因自身过错未办理登记的不动产买受人属于完整的事实所有权人。不动产物权变动过程中的中间型权利无从证立。囿于“登记不能”的现实困境,借由目的解释和体系解释,《查封扣押冻结规定》第15条后段和《执行异议复议规定》第28条可释入《民法典》第209条第1款中的“但书”规定,构成不动产物权变动的例外情形。在此情形下,公示媒介由登记降格为占有,作为“债权形式主义”的替代。此种不动产占有应限缩为直接占有,至多包括新设的间接占有,以确保其公示力和公信力。

Abstract: In the post-civil-code era,particular attention should be paid to the systemic effects of substantive law and procedural law,and the substantive law issues in the execution procedure urgently need to be resolved by civil law theory and norm.The buyer of the real estate who has actually taken possession of the real estate and paid the full price,but has not registered without his own fault,belongs to the complete factual owner.Intermediate rights in the process of real estate rights changes cannot be justified.Confined to the real dilemma of“registration impossible”,by means of purposeful and system interpretation,the latter paragraph of article 15 of the“Provisions of the Sealing,Seizure,and Freezing of Property”and article 28 of the“Provisions of Enforcement Opposition and Reconsideration”can be regarded as the proviso in paragraph 1 of article 209 of the Civil Code,which constitutes an exception to the change of ownership of real estate.In this case,public media is reduced from registration to possession,as an alternative to“formalism of creditor's rights”.At this time,real estate possession should be confined to direct possession,including at most newly established indirect possession to ensure its publicity and credibility.
