土地经营权所涉无权占有类型区分与法律适用

摘要: 土地经营权人对农村土地的占有、使用、收益,甚或对土地经营权之转让、抵押以及优先权实现均可能涉及《物权法》第242条所指向的无权占有。如果全盘适用第242条,势必缩减土地经营权人的权利空间;如果不予适用,则会导致承包人权益受损,甚至危及集体所有权。值此民法典编纂之际,唯有具体区分土地经营权所涉无权占有之具体类型并有针对性适用,始能达成土地所有权、土地承包经营权、土地经营权之平衡,维护农地的稳定经营与效益增长,为乡村振兴战略提供可靠的制度供给。

Abstract: The possession, use and income of the land by the owner of the right of operation, transfer and mortgage the management right may involve the unauthorized possession of Article 242 of Real Right Law.If Article 242 is applied, the right space of farmland management right will be reduced.If it is not applied, it will lead to the damage of the interests of the contracting party and even to the collective ownership.On the occasion of the compilation of the civil code, only by distinguishing specific types of unauthorized possession involving the right of farmland management and pertinent application, can the balance of collective ownership, peasant household contract rights, and the rights and interests of rural land management rights be reached, to maintain stable operation and benefit growth of farmland, and to provide a reliable system supply for the strategy of Rural Revitalization.
