摘要: 劳动法中的工资概念因对价理论的缺陷而丧失其体系化功能。在马克思主义立场上反思,工资的法律概念可以被解释为能够被劳动法正当化的、社会主体“同意”的、可由劳动者支配的、劳动所创造的价值,并应遵循关系正义理论发展出的“对等决定劳动条件”原则与“权利不得滥用”原则重新构想其在劳动法中的意义脉络。工资法律制度是通过正义原则引导形成秩序的三种力量—强制、习俗与互惠使劳动关系趋向合作秩序的制度建构。如此勾勒出工资法原则与其下位概念的工资制度之间的关联方式及其与劳动者权利体系之间错落有致的搭配,实现其对外部法律体系的建构功能。

Abstract: As an abstract conception, the construction of wages based on theory of consideration failed to establish co-herent relationship between conception and law system. Through reflection from Marxist standpoint, the essence of wages is how to distribute social treasure equally. Based on it, wages in labour law could be constructed as afunctional conception. It will be constructed in a way of guiding agreement, compulsion and custom to form har-monious social order in accordance with basic principles of equity and social justice. It will outline the thread ofwages concept and the law practice, and also explain functions of law system of the concept of wages perfectly.
