摘要: 北极海域200海里外大陆架划界的法律问题与北极区域法律制度建构的路径选择有紧密关联。对北极海域200海里外大陆架划界法律问题的认识,必然涉及对于北极区域法律制度建构的路径选择和前景判断。北极海域200海里外大陆架划界法律问题的解决尚需时日,而北极区域法律制度的建构有助于为北极国家与非北极国家的制度合作提供保障。在认同国家在北极事务上的优先权的同时,中国应加强对北极海域200海里外大陆架划界问题的法理解读,以及对北极区域法律制度建构议题的规范参与,以便更好地促进各方的合作共赢,维护中国和广大非北极国家在北极地区的合法权益。

Abstract: The legal issues of delimiting outer continental shelf beyond 200 nautical miles in the Arctic Seas are closely associated with the route choice of the construction on the Arctic regional legal system. The trend of the former has a far-reaching influence over the latter. Therefore, the interpretation on the legal issues of delimiting outer continental shelf beyond 200 nautical miles in the Arctic Seas inevitably involves the route choice and prospect prediction of the construction on the Arctic regional legal system. It would take a long time to solve the legal issues of delimiting outer continental shelf beyond 200 nautical miles in the Arctic Seas, whereas the construction on the Arctic regional legal system is helpful to provide system guarantee for promoting cooperation between the Arctic States and Non-Arctic States. At the same time of pragmatically recognizing the priority rights of the Arctic States in the Arctic affairs, China should enhance the interpretation on the issues of delimiting outer continental shelf beyond 200 nautical miles in the Arctic Seas in light of jurisprudence, as well as the normative participation in the topics for discussion about the construction on the Arctic regional legal system, in order to promote the win-win cooperation of all parties concerned around the Arctic better, and to protect China and the vast majority of Non-Arctic States, legitimate rights and interests in the Arctic Region.
