摘要: 《物权法》第20条规定了预告登记制度,它适用于房屋买卖、抵押等引致不动产物权变动的交易,功能是通过防范不动产物权人的一物数卖等行为,来确保买受人等债权人实现其请求权。在房屋买卖或抵押交易中,网上签约机制发挥着防止所有权人一房数卖的实际作用,这与预告登记制度的功能高度重合,导致预告登记制度在实践中走向死亡。为了避免制度资源的浪费,使预告登记制度获得再生,有必要调整其适用领域,进行制度整合和创新,把租赁权、优先购买权等也纳入其中。

Abstract: Article 20 of Property Law stipulates the Advance Notice Registration System, which is applied to the transactions of the change of real right resulting from the sale of real estate, mortgage and so on.The function of the system is to make sure the creditors, such as vendees, to realize their claims through preventing the acts such as selling real estate for times.In the course of real estate transaction or mortgage, the mechanisms, such as signing contracts on the internet, share the same function with the Advance Notice Registration System and leads the System to the end in practice.To avoid the waste of system resources and to make the System survive, it is necessary to adjust the fields where it applies in, make integration and innovation, and bring the leasehold, preemptive right and other similar rights into the System.
