摘要:
汉斯·凯尔森的国家与法律同一的法治国家观揭示了国家的规范性特征,而例外情形的出现,使得卡尔·施米特的政治国家观与黑格尔的伦理国家观成为法治国家观重要的理论对手。然而,关键问题不在于国家的政治性与伦理性,而在于凯尔森所忽略的规范性的品质问题。不同的规范性之品质对应的是不同的文化法治国观念。按照拉德布鲁赫的观点,文化是跨人格间生成的作品。文化的本体是连属关系,而契约关系以及交往关系都是文化的辅助性要素。只有建立以连属文化(“一家亲”文化)为主、商业文化与公共商谈文化为辅的价值评判和法律规范体系,才能提升文化法治国的规范品质,更好地抵御各种例外状态的发生。

Abstract:
Hans Kelsen's view of the state of law,which means the identity of law and state,reveals the characteristic of normativity of the state.The emergence of exceptional state makes Carl Schmitt's view of political state and Hegel's view of ethical state become the theoretical opponents of the view of the state of law.However,the key problem is not the political and ethical nature of the country,but the quality of normativity ignored by Kelsen.Different normative qualities correspond to the concept of cultural state of law.Culture is a work produced by the trans-personal communication according to Radbruch.The noumenon of culture is the relation of articulation,while the relation of contract and communication are all the subsidiary elements of culture.Only by establishing an evaluation system with the culture of articulation,namely the culture of family,as the main part and the culture of business and democratic consultation as the subsidiary part,can we improve the quality of the rule of law and the governance capacity and better resist the occurrence of all kinds of exceptions.
