摘要： 立法活动中的提取公因式技术应当遵循立法的逻辑而非数理计算的逻辑,包括确定待提取对象、进行公因式提取以及对公因式规范和剩余规范进行安置表达三个步骤。生态环境法典的待提取对象包括总则中的基本制度以及分则中特有的普遍规范。立法机关既可以运用常规的归纳提取法,也可以运用演绎提取法先形成共通性规范再进行规范演绎。立法机关进行公因式规范表达时需要注意尽量以现有规范和最新规范为基础,并注意政策用语和学术概念向规范概念的转化。对于剩余规范,则要根据情况调整为独立规范、合并入公因式规范或者转移位置。

Abstract: The technique of Extracting Common Factors in legislative activities should follow the logic of legislation rather than the logic of mathematical calculations, including three steps of determining the objects to be extracted, carrying out the Extracting Common Factors, and placing the expression of the Common Factors norms and the remaining norms.The objects to be extracted from the Eco-Environmental Code include the basic system in the general provisions and the specific universal norms in the sub-legal provisions.The legislature can either use the conventional inductive extraction method or the deductive extraction method to form the common norms and then carry out norm deduction.The legislature needs to pay attention to the existing norms and the latest norms as far as possible as the basis for the expression of common sense norms, and pay attention to the transformation of policy terms and academic concepts into normative concepts.As for the remaining norms, they should be changed into independent norms, merged into the causal norms or shifted to a different location, depending on the situation.
