摘要： 知识产权滥用行为不仅会对被许可人的利益造成不正当的侵害，而且会危害贸易秩序，阻碍技术的传播和发展。因此，对其进行规制是国际上的普遍做法。TRIPS协定在几个条文中都作了限制知识产权滥用的规定。加入世界贸易组织以后，我国对《对外贸易法》进行了修改，在对外贸易法第30条中对知识产权滥用行为规定了限制措施。该规定与TRIPS协定的内容是一致的。这是我国第一次在法律层面上就该问题作出规定，对我国知识产权制度的发展具有重要意义。

Abstract: An abuse of i ntellectual property rights（IPRs）not only violates the interests of licensees but also harms the foreign trade order and impedes the dissemination and development of technology．Thus．it is internationally accepted that the abuse should be regulated．There are several articles in the TRIPs Agreement prescribing the abuse of IPRs．After China’S entry into the WTO．the Foreign Trade Law was amended and measures to restrict the abuse of IPRs were incorporated in its Article 30．The content of Article 30 is consistent with the relevant regulations of TRIPS Agreement．It is the first time that the abuse of intellectual property is regulated in law level and it is believed that this article will promote the development of intellectual property system in China．
