摘要： 本文以考察执政党与人大立法关系为主线，以加强我国执政党的立法职能作为出发点，首先阐述了中国执政党与人大立法关系的现状与存在的问题，然后分析和总结了西方政党与立法关系的规律和特点，最后结合从“领导党”向“执政党”转变的历史大背景，从理论上对于当前我国执政党与人大立法关系的定位与重构加以探讨。

Abstract: on the background of the transformation from the“Leading Party”to the“Ruling Party”，the relation between the CCP and People’s Congress should be emphasized and re—oriented properly．This article tries to illustrate the present situation of the relation between the Chinese ruling Party and State legislation．Under the enlightenment of the characteristics of western party and legislation，this paper put forward several standpoints on handling and approaching the relation between the CCP and People’s Congress from a theoretical perspective．
