摘要： 自由是金融市场及其法律制度的本性，金融自由就是金融行为自由，从法律制度上就是金融法律行为自由。安全是金融法律的基础性原则。金融自由和金融安全是一矛盾，法律必须在金融自由和金融安全之间寻求平衡。在我国现阶段，矛盾的主要方面是金融安全，只能在金融安全的前提下逐步放开金融自由的缰绳。

Abstract: Liberty is the nature of financial market and financial legal system．Financial liberty is the freedom of financial action，and from legal system，is the freedom of financial legal action．Security is the basic legal principle of financial laws．Financial liberty and Financial security form a couple of contradiction．Financial law should look for the balance between liberty and security．In the present situation of China，Financial security is the critical aspect of the contradiction So only on the base of security，we gradually relax the control of financial freedom．
