摘要： 违宪构成是确定违宪的标准，对宪法责任制度、宪法救济制度及宪政实践具有基础性的理论价值。违宪构成概念是建构我国宪法监督及宪法诉讼制度的基石，同时我国宪政实践中许多宪法案件得不到有效处理的根本原因在于对违宪构成缺乏基本的认识。本文在综合国内对违宪的几种学术观点的基础上，对违宪进行了重新界定，据此提出了违宪构成诸要素的具体内容。

Abstract: The constitutive requirements of violation of the constitution is the norm of confirmation of violation of the constimtion，which possess the basic theoretical value to constitution liability system，constitution remedy system and constitution practce．The definition of the constitutive requirements of violation of the constitution is the foundation stone of China’s constitution supervision and constimtion litigation systems．The ignorance of the constitutive requirements of violation of the constitution is the cardinal：reason that many constitution cases cannot．be solved effectively inChina．The essay renews the defintion of violalion of the constitution and raise the concise contese the contents of the  constituive requirements of Violation of the constitution consequently．
